These terms govern your use of tartanbuildersinc.com and describe how we work. Where you sign a written contract with us for work at your property, that contract governs the work itself and takes precedence over anything here.

Acceptance
By using this website, submitting a form, or engaging Tartan Builders Inc. for services, you agree to these terms. If you do not agree, please do not use the site.
What We Do
Tartan Builders Inc. provides roofing, siding, gutter, fascia and soffit services, and storm damage restoration, in Ohio and — for major storm events — in other states we serve.
Descriptions of services on this site are general. What we will actually do at your property, and for what price, is set out in your written estimate and contract.
Inspections and Estimates
Inspections are free and carry no obligation. An estimate is an offer to perform described work at a stated price; it is not a contract until both parties sign one.
Estimates are based on what is visible and measurable at the time. Roofing work regularly uncovers conditions that cannot be seen before tear-off — most commonly damaged roof decking. Where that happens, additional work is priced at the rate stated in your estimate and requires your approval before we proceed.
Estimates are valid for the period stated on them. Material prices move, and an expired estimate may need to be re-issued.
Insurance Claim Assistance
Where you ask us to, we will document storm damage, meet your insurance adjuster, prepare a line-item estimate, and submit supplements for work the carrier’s scope omits.
We are not public adjusters and we are not your legal representative. We do not negotiate your claim on your behalf as your agent, and we do not give legal or insurance advice. Decisions about your policy and your claim are yours.
We cannot guarantee that any claim will be approved, or approved at any particular amount. Those decisions belong to your insurance carrier.
We will not waive, absorb, discount, rebate or otherwise pay your insurance deductible, and we will not misrepresent anything to your carrier. Doing so is insurance fraud in Ohio and exposes both parties.
Your Right to Cancel
Ohio law gives you the right to cancel certain home solicitation sales — broadly, contracts signed somewhere other than our permanent place of business, such as at your home — within three business days of signing, without penalty.
If that right applies to your contract, the notice of cancellation and instructions will be provided with it. To cancel, follow those instructions in writing within the stated period.
Scheduling, Weather and Access
Roofing is weather-dependent. We do not install in rain, and cold slows shingle sealing. Start dates and completion dates are estimates in good faith, not guarantees, and weather delays are not a breach of contract.
You agree to provide reasonable access to the property, including space for a dumpster and materials, and access to electrical power. You are responsible for moving or protecting vehicles, valuables and fragile items in the work area, and for securing pets.
We take reasonable care of landscaping and property, and we clean up thoroughly, including running magnets for nails. Some disturbance is unavoidable in roofing work — vibration can dislodge items in an attic or on walls, and we recommend removing them beforehand.
Payment
Payment terms are set out in your contract. Where insurance is funding the work, the schedule generally follows the carrier’s payments, and you remain responsible for your deductible and for any work not covered by the claim.
Where your mortgage lender is named on an insurance cheque, releasing those funds is the lender’s process, not ours. Delays in that process do not change what you owe.
Overdue balances may accrue interest and collection costs where permitted by law and stated in your contract.
Warranties
Materials are covered by the manufacturer’s warranty. Where we install a GAF system and you qualify, GAF warranties including the Golden Pledge may be available; those are issued by GAF on GAF’s terms, and registration is your responsibility.
Our workmanship warranty, where offered, is stated in your contract. It does not cover damage from storms, impact, misuse, neglect, alterations by others, structural movement, or pre-existing conditions we identified and you declined to address.
Warranty coverage assumes the balance owed has been paid in full.

We link to third-party sites, including GAF and our social media profiles. We do not control them and are not responsible for their content, products or practices.
Limitation of Liability
To the fullest extent permitted by law, Tartan Builders Inc. is not liable for indirect, incidental, special or consequential damages arising from your use of this website.
Nothing in these terms limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence.
Our obligations for work performed at your property are governed by your contract with us and by applicable Ohio law.
Governing Law and Disputes
These terms are governed by the laws of the State of Ohio, without regard to conflict-of-law rules. Any dispute relating to this website or these terms will be brought in the state or federal courts located in Ohio, and you consent to that jurisdiction.
If any provision of these terms is held unenforceable, the rest remain in effect.
Changes
We may update these terms. The date at the top shows the last revision. Continuing to use the site after an update means you accept the revised terms.
